(Des Moines) The Iowa Supreme Court has ordered the State Health Department to place the names of a Lesbian couple as the parents on a child’s birth certificate.
In 2009, the Iowa Department of Public Health refused to put the names of parent’s heather and Melissa Gartner on the birth certificate for their daughter MacKenzie agreeing only to put Heather’s name on it because she was the mother. The Gartner’s filed suit and a lower court Judge in Polk County found in favor of them ordering the Health Department to use both names.
The state then appealed. The high court has ruled the refusal to list both names violates the equal protection and due process clauses of the Iowa constitution. The Supreme Court also ordered the District Court to lift its’ stay of its’ decision to allow other Lesbian parents the same opportunity to have both names listed on the child’s birth certificate.
