(ATLANTIC) A Cass County man accused of shooting and killing a dog that wandered into his yard is set to go to trial next month.
According to courts online, Charles Collins Cutler is scheduled to go to trial on April 16th on a charge of animal abuse in the incident that occurred on December 24, 2012. A pre-trial conference has been scheduled for April 8th.
The Cass County Sheriff’s Office says a dog owner from Denver, Colorado, reported that her dog was playing with a relative’s dog in the church lot adjacent to Cutler’s residence. The dog allegedly wandered onto Cutler's property where he is accused of shooting it. The dog was taken to a local vet where it died.
Cutler has pleaded not guilty.
