(Atlantic) The Cass County man accused of shooting and killing a dog that had wandered into his yard is set to go to trial next month.
According to courts online, Charles Collins Cutler is scheduled to go to trial on March 26 on a charge of animal abuse and reckless use of a firearm for an incident that occurred on December 24, 2012.
The Cass County Sheriff’s Office says a dog owner from Denver Colorado, reported that her dog was playing with a relative’s dog in the church lot adjacent to Cutler’s residence. The dog allegedly wandered onto Cutlers’ property where he is accused of shooting it. The dog was taken to a local vet, where it died.
Cutler has pleaded not guilty.
