(Council Bluffs) The Iowa Court of Appeal’s has turned down a former Army Officer’s Appeal in a case where he is accused of breaking into a Council Bluffs apartment and assaulting a female.
The court rejected the request from former Lt. Colonel Robert Butts, who claimed there were several problems with his 2010 jury trial. He was sentenced to 25-years in prison for seven charges, including second-degree kidnapping.
Butts was accused of breaking into a woman’s apartment on November 11, 2009, and holding her at gunpoint. The female’s sister, who was hiding in a closet, called police.
During the trial, Butts testified that he didn’t remember what happened that night. A psychiatrist testified Butts had a history of sleepwalking.
