(Council Bluffs) A Grand Jury says no charges will be filed in the shooting death of John Anthony Rodarte on April 13, 2011.
On Tuesday, the Grand Jury considered charges against Robert Keith Hashberger in relation to the shooting death of Rodarte and returned a No Bill. This means that they have declined to file charges. The no bill was filed with the Clerk of the District Court this morning and concludes the Pottawattamie County Attorney’s Office involvement with this matter.
John Rodarte was shot and killed by Hashberger following a verbal altercation at the Do Rock Inn, in Council Bluffs. Hashberger has claimed that he was acting in self-defense. He was initially charged with First Degree Murder. However, after further investigation and depositions of eyewitnesses to the shooting, Pottawattamie County Attorney Matt Wilber says his office has dismissed those charges and submitted the matter for consideration by the Grand Jury.
Wilber says that while federal prosecutors routinely use Grand Juries, state prosecutors in Iowa rarely use them. However, the Grand Jury serves a very important role as the conscience of the community in cases such as this. The proceedings before the Grand Jury are secret and Wilbert cannot comment further upon the evidence considered yesterday.
